General Terms and Conditions of Rotho Sp. z o. o.

1. Validity

Our deliveries are made solely on the basis of these General Terms and Conditions (GTC). These GTC apply to the execution of all orders placed in the online store operated by Rotho Sp. z o. o. at www.pl.rotho.com (full company data as the Data Administrator can be found in point 10 of this document). The discussed GTC are considered accepted by the customer during the registration of the Account or during the order placement process (for users not using the account function), by checking the appropriate checkbox confirming that they have read the GTC and accept their wording.

Our online product offers are valid only when visible on the website and until stocks are exhausted. The images presented on the site are for illustrative purposes and are not binding.

2. Conclusion of the contract

On the website www.pl.rotho.com, the user can place an order by using the Account registration function, which also allows them to view the order archive, check the status of the current order, download the complaint form and return form, as well as the invoice in electronic form. To create an Account, the user must familiarize themselves with the regulations and the principles of personal data processing (available at the link https://pl.rotho.com/pages/polityka-prywatnosci ) and confirm their consent to its provisions. Using the electronic Account service on the site is not mandatory for the effective placement of an order.

The user places an order by selecting the products of interest in the service and adding them to the virtual shopping cart, and then proceeds to the next step, which is logging into the Account with their login and password provided during registration, and in the case of not having an account, going directly to the panel allowing them to enter contact details, the shipping address of the order, and the shipping method itself. In the case of a user placing an order without registering/logging into the Account, they must additionally confirm by checking the checkbox that they have read the wording of the regulations and the principles of personal data processing and express their consent to them.

Then the user proceeds to the stage of selecting the payment method and finalizes the transaction in the selected transaction service. With the final confirmation of the order, you submit to us a binding offer to conclude a sales contract. You will then receive an email from us promptly confirming the receipt of the order; for users using the Account service, this information will also be visible in the "Orders" tab. The acceptance of the order, and thus the conclusion of the contract, occurs at the moment of delivery of the order confirmation with the reference number of the shipment (allowing for tracking), when the shipment has occurred. In the case of prepayment, we confirm the conclusion of the contract by sending the details of our account.

We reserve the right to change prices and assortment at any time. Deliveries will be made only if the delivery address and billing address are located in Poland. There is no minimum order value.

If after confirming the order it turns out that the delivery cannot be fulfilled in full because certain products are temporarily out of stock, we will inform the customer by email about the new delivery date.

3. Prices and shipping costs

All prices include the statutory turnover tax or VAT.

When placing an order, the User selects their preferred delivery method from the carriers provided by Rotho Sp. z o. o. - InPost Courier or InPost Parcel Locker, both services provided by InPost S.A. based in Krakow, ul. Wielicka 28, 30-552 Kraków, NIP: 6793087624, KRS: 0000536554

Shipping costs below a cart value of 120 PLN are covered by the customer. The shipping cost is 18.99 PLN (gross).

The cart value above 120 PLN is covered by Rotho Sp. z o.o. (free shipping for the consumer).

4. Delivery time

All deliveries are made within 6 working days. If we do not have a given item in stock, we will immediately inform you of the new delivery date.

5. Payment terms

The user makes the payment by prepaying, choosing one of the available methods, via:

6. Retention of title

The delivered goods remain our property until full payment is made. The customer is obliged to cooperate in actions necessary to protect our property.

7. Right of return and return instructions

If you are a consumer, i.e., a natural person who makes a purchase for a purpose that cannot be attributed to your business or self-employment, you have the right to return described below. This does not apply to goods that have been made specifically for you according to individual customer specifications.

Return instructions

You can return the received goods without giving a reason within 14 days of receiving them, by sending them to Rotho Sp. z o. o. - ul. Władysława Grabskiego 2, 75-209 Koszalin, using the return form available on the website www.pl.rotho.com/zwrot

The complaint will be processed within 14 days.

Effects of return

In the case of a successful return, the services received by both parties are returned. The return of products is effective only if the items are sent back to Rotho Sp. z o. o. in an undamaged condition, which does not indicate that the products were used other than merely to check their properties and functionality. Goods showing signs of other use beyond the two purposes mentioned above are not subject to return. "Checking properties and functionality" means testing and trying out individual goods, which is possible and commonly accepted, e.g., in a retail store. Rotho Sp. z o. o. processes the return and in the case of a positive decision refunds the costs within 30 days from receiving the goods from the customer.

8. Warranty and right to exchange

The statutory warranty provisions apply. In the case of defects in delivery, please contact our Customer Service Department via email (customer.service@rotho.com) as soon as you notice them. The Customer Service Department will send you a return label within two to three days. You can return defective goods to us at no shipping cost. We will replace defective goods. If in individual cases this is impossible or unacceptable, we will refund the already charged purchase price.

9. Jurisdiction, applicable law, severability clause

If you are a buyer, a commercial company, or a legal entity of private or public law or a public law separate property, the local jurisdiction for resolving any disputes arising from the contractual relationship or related to it is the seat of Rotho Sp. z o. o., with the right to hold you liable in your place of residence or seat or in any other local jurisdiction permitted by law. In the case of disputes arising from consumer contracts, you may file a lawsuit in the place of residence or seat of one of the parties.

All legal relations between us and the customer are subject to Polish law. If individual provisions of these GTC are inadmissible, it will not affect the validity of the remaining clauses.

10. Special campaigns

Spring campaign conditions: March 6-19, 2024.

  • To take advantage of the 30% discount, you must use the VOUCHER code provided during the payment process.
  • The VOUCHER code must be applied before finalizing the purchase.
  • Delivery of discounted products may take longer, up to 10 working days.
  • Other conditions, including minimum shipping costs, remain unchanged.
  • Special offers (e.g., coupon codes) will not be added.
  • During this period, an extended customer service response time applies (up to 10 working days).
